California health insurance laws vary from the laws governing other states when it comes to small business health coverage. Often these types of health insurance policies are easier to qualify for than an individual health insurance policy, even if you are in poor health.

California Small Business Health Plan Regulations

According to California health insurance laws, small group health insurance must be offered to any small business who is interested in applying for it. In addition, a small business with 2 to 50 employees must be offered the same health insurance policy that the insurance company sells to other small businesses in the California

However, there is one requirement that California health insurance companies can impose... minimum enrollment requirements. Simply put, a minimum % of employees within the company must purchase the insurance policy or the policy can be rescinded by the insurance company.

California health insurance laws also make it illegal for any health insurance company to charge higher premiums due to the insured group's health status. However, premiums can vary due to the group's age, family size and geographic location.

Finally, health insurance companies cannot cancel any California small group health plan because an employee becomes ill.
